Available in PDF, EPUB and Kindle. Book excerpt: Looking beyond the events of the second intifada and 9/11, this book reveals how targeted killing is intimately embedded in both Israeli and US statecraft, and in the problematic relationship between sovereign authority and lawful violence underpinning the modern state system. It details the legal and political issues raised in targeted killing as it has emerged in practice, including questions of domestic constitutional authority, the use of force in international law, the law of belligerent occupation, the law of targeting and human rights law. The distinctive nature of Israeli and US targeted killing is analysed in terms of the compulsion of legality characteristic of the liberal constitutional state, a compulsion that demands the ability to distinguish between legal 'targeted killing' and extra-legal 'political assassination'. The effect is a highly legalized framework for the extraterritorial killing of designated terrorists that may significantly affect the international law of force.

Download or read book Debating Targeted Killing written by Tamar Meisels and published by Oxford University Press. This book was released on 2024-05-14 with total page 288 pages. Available in PDF, EPUB and Kindle. Book excerpt: Known terrorists are often targeted for death by the governments of Israel and the United States. Several thousand have been killed by drones or by operatives on the ground in the last twenty years. Is this form of killing justified, when hundreds or thousands of lives are possibly at risk at the hands of a known terrorist? Is there anything about it that should disturb us? Ethically-sound and practical answers to these questions are more difficult to come by than it might seem. Renowned political theorists Jeremy Waldron and Tamar Meisels here defend two competing positions on the legitimacy of targeted killing as used in counterterrorism strategy in this riveting and essential for-and-against book. The volume begins with a joint introduction, briefly setting out the terms of discussion, and presenting a short historical overview of the practice: what targeted killing is, and how it has been used in which conflicts and by whom. It then hones in on killings themselves and the element of targeting. The authors tackle difficult and infinitely complex subjects, for example the similarities and differences between targeted killing of terrorists and ordinary killings in combat, and they ask whether targeted killing can be regarded as a law enforcement strategy, or as a hybrid between combat and law enforcement. They compare the practice of targeted killing with assassination and the use of death squads. And they consider the likelihood that targeted killing has been or will be abused against insurgents, criminals, or political opponents. Meisels analyzes the assassination by Israeli operatives of nuclear scientists working for regimes hostile to Israel. Meisels and Waldron carefully consider whether this sort of killing can ever be justified in terms of the danger it, in theory, averts. The conclusions drawn are at once as surprising as they are insightful, cautioning us against a world in which targeted killing is the norm as it proliferates rapidly. This is essential reading not only for students of political and war theory and military personnel, but for anyone interested in or concerned by the future of targeted killing.

Download or read book Israel s Targeted Killing Policy written by Boaz Ganor and published by Springer Nature. This book was released on 2023-10-25 with total page 236 pages. Available in PDF, EPUB and Kindle. Book excerpt: The book explores the main moral, ethical and operational dilemmas of targeted killings from an Israeli perspective. Even though many countries contending with terrorism have adopted this tool (either overtly or covertly) within the arsenal used in implementing their counter-terrorism policies, it seems that Israel, as one of the world's leading practitioner of targeted killing in its counter-terrorism effort, constitutes the most appropriate case study for reviewing implications and dilemmas associated with this practice. Each chapter will present a different ethical–moral–operational dilemma emanating from a deployment of a targeted killing. The analysis of Israeli considerations and solutions to these dilemmas is built around interviews with Israeli decision-makers, former senior security officials and other experts. The chapters also cover public opinion polls in order to highlight the views of the Israeli public vis-a-vis each dilemma. Finally, chapters will conclude with lessons learned and offer recommendations for a practical and moral solution. The final chapter then draws together universal conclusions and recommendations for the use of targeted killings.

Download or read book Drones and the Ethics of Targeted Killing written by Kenneth R. Himes and published by Rowman & Littlefield. This book was released on 2024-09-03 with total page 214 pages. Available in PDF, EPUB and Kindle. Book excerpt: Drones have become an essential part of U.S. national security strategy, but most Americans know little about how they are used, and we receive conflicting reports about their outcomes. In Drones and the Ethics of Targeted Killing, ethicist Kenneth R. Himes provides not only an overview of the role of drones in national security but also an important exploration of the ethical implications of drone warfare—from the impact on terrorist organizations and civilians to how piloting drones shapes soldiers. Targeted killings have played a role in politics from ancient times through today, so the ethical challenges around how to protect against threats are not new. Himes leads readers through the ethics of targeted killings in history from ancient times to the contemporary Israeli-Palestinian conflict, then looks specifically at the new issues raised through the use of drones. This book is a powerful look at a pressing topic today.

Download or read book Cultural Politics of Targeted Killing written by Kyle Grayson and published by Routledge. This book was released on 2024-07-15 with total page 230 pages. Available in PDF, EPUB and Kindle. Book excerpt: The deployment of remotely piloted air platforms (RPAs) - or drones - has become a defining feature of contemporary counter-insurgency operations. Scholarly analysis and public debate has primarily focused on two issues: the legality of targeted killing and whether the practice is effective at disrupting insurgency networks, and the intensive media and activist scrutiny of the policy processes through which targeted killing decisions have been made. While contributing to these ongoing discussions, this book aims to determine how targeted killing has become possible in contemporary counter-insurgency operations undertaken by liberal regimes. Each chapter is oriented around a problematisation that has shaped the cultural politics of the targeted killing assemblage. Grayson argues that in order to understand how specific forms of violence become prevalent, it is important to determine how problematisations that enable them are shaped by a politico-cultural system in which culture operates in conjunction with technological, economic, governmental, and geostrategic elements. The book also demonstrates that the actors involved - what they may be attempting to achieve through the deployment of this form of violence, how they attempt to achieve it, and where they attempt to achieve it - are also shaped by culture. The book demonstrates how the current social relations prevalent in liberal societies contain the potential for targeted killing as a normal rather than extraordinary practice. It will be of great use for academic specialists and graduate students in international studies, geography, sociology, cultural studies and legal studies.

Download or read book Targeted Killings written by Claire Finkelstein and published by OUP Oxford. This book was released on 2024-03-01 with total page 520 pages. Available in PDF, EPUB and Kindle. Book excerpt: The war on terror is remaking conventional warfare. The protracted battle against a non-state organization, the demise of the confinement of hostilities to an identifiable battlefield, the extensive involvement of civilian combatants, and the development of new and more precise military technologies have all conspired to require a rethinking of the law and morality of war. Just war theory, as traditionally articulated, seems ill-suited to justify many of the practices of the war on terror. The raid against Osama Bin Laden's Pakistani compound was the highest profile example of this strategy, but the issues raised by this technique cast a far broader net: every week the U.S. military and CIA launch remotely piloted drones to track suspected terrorists in hopes of launching a missile strike against them. In addition to the public condemnation that these attacks have generated in some countries, the legal and moral basis for the use of this technique is problematic. Is the U.S. government correct that nations attacked by terrorists have the right to respond in self-defense by targeting specific terrorists for summary killing? Is there a limit to who can legitimately be placed on the list? There is also widespread disagreement about whether suspected terrorists should be considered combatants subject to the risk of lawful killing under the laws of war or civilians protected by international humanitarian law. Complicating the moral and legal calculus is the fact that innocent bystanders are often killed or injured in these attacks. This book addresses these issues. Featuring chapters by an unrivalled set of experts, it discusses all aspects of targeted killing, making it unmissable reading for anyone interested in the implications of this practice.

Download or read book Ethics Law and Justifying Targeted Killings written by Jack McDonald and published by Routledge. This book was released on 2024-08-05 with total page 214 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book examines the normative debates around the American use of targeted killings. It questions whether the Obama administration’s defence of its use of targeted killings is cohesive or hypocritical. In doing so, the book departs from the disciplinary purpose of international law, constitutional law and the just war tradition and instead examines discipline-specific defences of targeted killings to identify their requisite normative principles in order to compare these norms across disciplines. The methodology used in this book means that it argues that targeted killings are only defensible as acts of war, but it also highlights the normative role of accountability and responsibility in this defence. In doing so, it offers an argument that the use of ‘pattern of life’ killings by the CIA falls outside the defence offered by the Obama administration, but that this same type of targeting could be used by the military due to differing standards/mechanisms of responsibility assignment in these organisations. The book thus provides a way of investigating contemporary wars where the conduct of war lacks the traditional hallmarks of conventional warfare. Furthermore, by drawing attention to differing normative concepts that underpin competing interpretations of law and morality, it provides a way of analysing contemporary political violence in an interdisciplinary fashion without seeking to displace single disciplinary study. This book will be of much interest to students of military studies, ethics of war, foreign policy, international security and IR.

Download or read book The Ashgate Research Companion to Military Ethics written by James Turner Johnson and published by Routledge. This book was released on 2024-03-23 with total page 472 pages. Available in PDF, EPUB and Kindle. Book excerpt: This Companion provides scholars and graduates, serving and retired military professionals, members of the diplomatic and policy communities concerned with security affairs and legal professionals who deal with military law and with international law on armed conflicts, with a comprehensive and authoritative state-of-the-art review of current research in the area of military ethics. Topics in this volume reflect both perennial and pressing contemporary issues in the ethics of the use of military force and are written by established professionals and respected commentators. Subjects are organized by three major perspectives on the use of military force: the decision whether to use military force in a given context, the matter of right conduct in the use of such force, and ethical responsibilities beyond the end of an armed conflict. Treatment of issues in each of these sections takes account of both present-day moral challenges and new approaches to these and the historical tradition of just war. Military ethics, as it has developed, has been a particularly Western concern and this volume reflects that reality. However, in a globalized world, awareness of similarities and differences between Western approaches and those of other major cultures is essential. For this reason the volume concludes with chapters on ethics and war in the Islamic, Chinese, and Indian traditions, with the aim of integrating reflection on these approaches into the broad consideration of military ethics provided by this volume.

Download or read book Drone Strike Analyzing the Impacts of Targeted Killing written by Milton C. Regan (Jr.) and published by Springer Nature. This book was released on 2022 with total page 412 pages. Available in PDF, EPUB and Kindle. Book excerpt: The intense debate over US targeted drone strikes outside war zones has been limited by the failure to review and assess a considerable body of quantitative research and qualitative material on the impacts of such strikes on terrorist groups and civilians. This book fills an important gap in the literature by conducting a careful and rigorous review of such evidence. It argues that decisions about the use of targeted strikes as a counterterrorism instrument, as well as legal and ethical evaluations of such use, must be informed by our best understanding of the insights that empirical evidence can provide on the effectiveness of strikes and the costs they impose on populations where they occur. Mitt Regan is McDevitt Professor of Jurisprudence and Co-Director of the Center on National Security at Georgetown Law Center, and Senior Fellow at the Stockdale Center for Ethical Leadership at the US Naval Academy. .

Download or read book Targeted Killings Law and Counter terrorism Effectiveness written by Ophir Falk and published by . This book was released on 2020 with total page pages. Available in PDF, EPUB and Kindle. Book excerpt: "This book examines the permissibility and effectiveness of targeted killing in campaigns against terror. Targeted killing has become a primary counterterrorism measure used by several countries in their confrontation with lethal threats. The practice has been extensively used by the US in Afghanistan, Iraq, Pakistan, Yemen and Somalia, and by Israel in the West Bank and Gaza. Several studies have already explored the difficult balance between achieving security while maintaining the liberties and rights of a country's civilians. This book goes a step further by seeking to examine whether maintaining those liberties by complying with legal standards and minimizing unintended deaths can be more effective for national security. Using targeted killing applied by Israel, in particular, as well as the United States during the first decade of the 21st century as case studies, this book explores that question and ultimately assesses whether compliance with legal standards can strengthen a state in its campaign against terrorism and thus provide stronger security. The book focuses on civilian-related criteria, hypothesizing that minimizing civilian casualties will maximize effectiveness in an asymmetric war setting. The conclusions are not limited to a specific tactic or theater, and if adopted might have far-reaching implications for how asymmetric warfare is strategized. This book will be of much interest to students of counter-terrorism, law, Middle Eastern studies, and security studies"--

Download or read book Fighting Terrorism written by Krauzová, Tereza and published by Charles University in Prague, Karolinum Press. This book was released on 2024-09-01 with total page 122 pages. Available in PDF, EPUB and Kindle. Book excerpt: The war on terror, launched by the 9/11 terrorist attacks, has been waged inside as well as outside the U.S. borders. Perception of threat and efforts to ensure national security have led the United States to major reforms in its national security policy, involving new military, security and legislative concepts. On the level of waging war outside the U.S. borders, the United States has introduced the system of Unmanned Aerial vehicles (UAVs), autonomous aircrafts without human pilot aboard, opening the possibility of highly effective computer game-like targeted killing. On the domestic level, new pieces of legislation and other antiterrorism measures have been raising privacy awareness and concerns whether the U.S. government keeps observing the Constitution. Nowadays, as advanced technology offers wide range of possibilities how to intrude one´s privacy and effectively kill people, legal and ethical considerations have to catch up the reality. This work therefore seeks to elaborate on the statutory and constitutional framework of the current U.S surveillance measures as well as the limits of utilization of UAVs.

Download or read book The Transformation of Targeted Killing and International Order written by Taylor & Francis Group and published by Routledge. This book was released on 2023-09-30 with total page 162 pages. Available in PDF, EPUB and Kindle. Book excerpt: This comprehensive volume addresses the important question of whether and how the current transformation of targeted killing is transforming the global international order. The age-old practice of targeted killing has undergone a profound transformation since the turn of the millennium. States resort to it more frequently, especially in the context of counter-terrorism operations. The rapid development of surveillance and drone technologies facilitates targeted-killing missions, and states are starting to slowly abandon their policies of secrecy and denial with regard to this form of violence. To answer this question, the volume introduces a theoretical framework that conceives the maintenance and transformation of international order as a dynamic, triangular process between violence, discourse, and the institutions that make up the international order. It then sheds light on different parts of this triangular process: the reinterpretation of international law to legitimize targeted killing, the contestation between state and non-state actors over the development of a new targeted-killing norm, the emergence of targeted killing in the context of changes in the broader normative context of international order, and the impact of new technologies, in particular autonomous weapons systems, on the future of targeted-killing practices and international order. This book was originally published as a special issue of Contemporary Security Policy.
